2003 Prius check engine light

    So I bought my son his first car with the money that we saved up he found a good looking 2003 Toyota Prius with only 129k miles on it.
    I looked it over good and we test drove it and everything seemed fine no issues it drove well etc so he decided he wanted it so I went back and forth and negotiated a bit with the seller and got him to come down a few hundred for an oil change and tags.
    But deep down I felt there was something shady about this seller. My gut was telling me to walk away but my son really liked and wanted the car. As soon as we bought it and he got his money he took the add down and blocked me on all social media so I could no longer contact him or view what he wrote in the add.

    Fast forward two days later and I get a panicked phone call from my son saying that the check engine light just came on. So I had him go to auto zone and get it coded.
    He said the car is driving fine and nothing feels wrong other than the CEL light. When they coded it the code turned out to be a P0440.

    I guess my question for the forums is if its ok to drive it with that code and emission leak issue for the time being until I can get a chance to look at it or take it to a mechanic or will it hurt the car?

    He really likes the car and we got it for a fairly good price 2700$ and it’s in good condition with lower miles 129k but that sort of worry’s me like I got to good of a deal. I really hope that the seller didn’t pull a fast one on us. But the CEL coming in after two days of buying it makes
    Me think he knew something was wrong with the car and wanted to get rid of it.
