Not true. While unlawful entry is illegal, unlawful presence is a civil matter, not criminal. A large portion of the "illegals", not quite half, entered legally, then their legal status expired later. A considerable portion of them are expired through no fault of their own, but because of the glacial pace of U.S. bureaucracy not being able to process their applications and renewals in a timely manner. This government inaction does not turn these people into criminals, just into undocumented persons.
